Thousands of new small businesses start up every year in the UK. You don’t need any special qualifications to start in business, although if you’re a small business owner you’ll quickly become aware of the amount of regulations that you have to comply with. Some of these you may have foreseen & made provisions for – you probably hired an accountant at any early stage in your business start-up.
How about staff though? What rules apply when hiring them? Of course, your accountant can help with taxes, making sure you make the right deductions, and pay the staff & the government what they’re each due. That bit might be easy, but when it comes to Employment Contracts, disciplinary & grievance procedures, holiday entitlements, flexible working, maternity & paternity rights, minimum wages, discrimination, performance, sick leave, dismissal, and many more issues, you could feel like burying your head in the sand - although that would be a big mistake, as all of these are compulsory issues for employers to deal with. The moment one of your employees makes a claim against you though, your whole business could fail.
If you think it won’t happen to you, think again: the latest stats from the Employment Tribunals shows that the trend for claims to Tribunals is that the number of appeals is annually increasing, and with average awards for dismissal-related claims of nearly £8,000 (which won’t include your costs for defending the case in the first place, or the costs awarded to the employee in bringing the claim), and a higher average for cases with discrimination, you won’t need your accountant to realise how the costs of getting employment issues wrong could quickly mount up & bring your business down.
To avoid problems in the workplace, small businesses would be well-advised to take professional advice – ideally before you find you have problems, rather than once these have arisen. Taking action early needn’t be costly, and could save your whole business in the future.
